Fine Policy

Per the By-Laws, Article VI, the Board has the authority to create a Fining Policy for the community. The policy is detailed below.
 
Option 1: Correction
• The owner corrects the violation within the specified time frame and notifies management.
• The Manager confirms that the violation has been corrected.
 
Option 2: Dispute
• Owner disputes the violation and files an appeal.
• Homeowners must submit an Appeal Form within 7 days.
• The Board will schedule a Special Meeting within 45 days of receiving the Appeal Form.
• Homeowner may attend the Special Meeting.
• The Board will make a final decision within 30 days of the Special Meeting.
 
2nd Violation Notice
• If a violation is not corrected within the specified time and no appeal has been filed, a 2nd Violation Notice will be mailed to the owner via a trackable method (i.e. FedEx with delivery confirmation or USPS Certified Mail) requesting that the violation be corrected within 15 days, and
• A fine will be assessed to the property for each violation, the amount of which is determined by the type of violation in the table provided and must be paid within 30 days.
• Notification of suspension of Community Amenities and the possibility of further legal action, including, but not limited to, lien and/or foreclosure.
3rd Violation Notice
• If upon further inspection by Association Manager, the violation is still not corrected, a third and final notice will be sent via a trackable method (i.e. FedEx with delivery confirmation or USPS Certified Mail) once again requesting that the violation be corrected within 15 days, plus;
• An additional fine will be assessed to the property for each violation, the amount of which is dependent on the type of violation as detailed in the table provided, that must be paid within 30 days.
• Warning that a lien will be filed if there is failure to comply and pay all fines within 30 days.
Legal Action
• Lien - If the homeowner fails to respond or comply through any of the steps listed above a lien will be filed against the property.
• Foreclosure - If the homeowner fails to bring the violation into compliance and pay all fees to remove the Lien, the Board may take further action, including, but not limited to, foreclosure.
 
Repeat Offenders
Repeating of same violation, even after it has been brought into compliance, will result in an acceleration of this process:
• 1st time repeat offenders start at 2nd Violation Notice level with the appropriate fine (payable within 30 days).
• 2nd time repeat offenders start at 3rd Violation Notice level with the appropriate fine (payable within 30 days).
